Rules for using Agoge

1. Acceptance of Terms

By accessing or using Agoge ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Agoge is an AI-powered fitness application that provides personalized workout recommendations based on recovery science and your fitness data. The Service includes:

  • AI-generated workout plans
  • Recovery tracking and calculations
  • Integration with third-party fitness services (Hevy, Whoop)
  • Progress tracking and analytics

3. Account Registration

To use the Service, you must:

  • Be at least 16 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Health Disclaimer

Agoge is not a medical service. The workout recommendations provided are for informational purposes only and should not be considered medical advice. Always consult with a qualified healthcare provider before beginning any exercise program.

You acknowledge that:

  • You use the Service at your own risk
  • We are not responsible for any injuries resulting from following workout recommendations
  • You should stop exercising and seek medical attention if you experience pain or discomfort
  • The Service does not diagnose, treat, or prevent any medical condition

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Share your account credentials with others
  • Use automated tools to access the Service without permission
  • Reverse engineer or attempt to extract the source code

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Agoge and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited license to use your data to provide and improve the Service.

7. Third-Party Integrations

The Service integrates with third-party services (Hevy, Whoop). Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or reliability of third-party services.

8. Subscription and Payments

Certain features of the Service may require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees
  • Provide accurate billing information
  • Automatic renewal unless cancelled before the renewal date

Refunds are handled on a case-by-case basis at our discretion.

9. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may delete your account at any time through Settings. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your data within 30 days
  • Provisions that by their nature should survive will remain in effect

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGOGI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Agoge and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance.
